Terms of Service

1. Agreement to Terms
By accessing or using FrameForged (“the Service”), operated by Strickland Services Group LLC, a Florida limited liability company (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree, do not use the Service. These Terms include a binding arbitration clause and a class action waiver in Section 13 that affect your legal rights. Please read them carefully.
2. Description of Service
FrameForged is an AI art generation and print-on-demand platform. Users generate artwork through text prompts using AI models hosted by third-party providers, and may purchase physically printed, framed, and shipped copies of their generated artwork through our fulfillment partners.
3. Accounts & Registration
You must be at least 13 years old to create an account (or at least 16 if you reside in the European Economic Area or the United Kingdom). You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must provide accurate and complete information during registration and keep it up to date.
4. Credits & Payments
Image generation requires credits. New accounts receive 5 free credits upon email verification. Additional credits may be purchased through the platform in fixed packages at prices listed on the pricing page. Payments are processed by Stripe, Inc.
Credits are non-refundable. Once purchased, credits do not expire while your account remains active but are forfeited if your account is terminated. Credits have no cash value and cannot be transferred, sold, or redeemed for money.
Prices are listed in USD and include the cost of printing and framing; shipping is calculated separately at checkout. We reserve the right to change prices at any time, but changes will not affect orders already placed.
5. AI-Generated Content & Intellectual Property
5.1 Your Content
You retain whatever rights applicable law grants you in the prompts you submit and the images generated from your prompts. You grant FrameForged a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, and display your content as necessary to operate the Service (including fulfilling your print orders). If you mark an image as “public,” you additionally grant us a license to display it in our public gallery and use it in marketing materials for the Service.
5.2 AI-Specific Disclaimers
- Uniqueness is not guaranteed. AI-generated outputs are produced by statistical models. Another user entering a similar prompt may receive visually similar imagery. We make no representation that your generated image is unique or unlike any other.
- Copyright status is unsettled. Under current U.S. law (see Thaler v. Perlmutter, 2023), works generated primarily by artificial intelligence without meaningful human creative contribution are generally not eligible for copyright protection. We make no representation that any generated image is copyrightable or that you hold enforceable copyright in it.
- We do not train AI models on your data. We do not use your prompts, generated images, or account data to train, fine-tune, or otherwise improve any AI model. Our upstream AI providers are contractually bound by their own terms regarding your data — please review those terms where relevant.
- Printability is not guaranteed. Generated images may not be suitable for printing at all sizes or aspect ratios. We upscale images before printing but cannot guarantee aesthetic outcomes. Credits spent on generations are not refundable for aesthetic reasons; refunds for technical failures are handled automatically via credit refunds.
- AI outputs may be unexpected. AI models may occasionally produce results that differ significantly from the prompt. This is a known limitation of the technology, not a defect in the Service.
6. Prohibited Use
You may not use the Service to:
- Generate content depicting minors in sexual, suggestive, or exploitative contexts
- Generate pornographic, explicit sexual, or other adult content
- Generate content designed to harass, threaten, defame, or promote violence against specific individuals or groups
- Generate content that infringes the copyright, trademark, right of publicity, or other intellectual property rights of others
- Attempt to reverse-engineer, scrape, rate-limit-circumvent, or otherwise abuse the platform
- Resell generated images as your own AI generation service or model-training dataset
- Submit prompts designed to bypass content safety filters (prompt injection)
- Violate any applicable law or regulation
We reserve the right to block, reject, or remove content that violates these Terms, and to suspend or terminate accounts engaged in prohibited conduct.
7. Print Orders & Fulfillment
Print orders are fulfilled by third-party providers (currently Prodigi Ltd). Delivery times are estimates and may vary. We are not responsible for delays caused by the fulfillment provider, shipping carrier, customs, or circumstances beyond our reasonable control. If you receive a damaged or defective product, contact us within 14 days of delivery for a replacement or refund.
8. Refund Policy
Credit purchases are non-refundable. For print orders, refunds or replacements are available if: (a) the product arrives damaged or defective, reported within 14 days of delivery; or (b) the order has not been delivered and no valid tracking information shows the package in transit more than 45 days after the order was placed. We will work with the fulfillment provider to resolve delivery issues before issuing refunds. Refund requests must be submitted to support@frameforged.com with your order number.
9. Copyright Infringement (DMCA)
We respect the intellectual property rights of others and expect our users to do the same. In accordance with the Digital Millennium Copyright Act, 17 U.S.C. § 512 (“DMCA”), we will respond to notices of alleged copyright infringement that comply with this section.
9.1 Notice of Alleged Infringement
If you believe that content on FrameForged infringes your copyright, please send a written notice to our designated agent at support@frameforged.com with the subject line “DMCA Notice.” To be effective, your notice must include all elements required by 17 U.S.C. § 512(c)(3):
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
- Identification of the copyrighted work claimed to have been infringed
- Identification of the allegedly infringing material and its location on the Service (e.g., direct URL) sufficient to allow us to locate the material
- Your contact information (address, phone number, email)
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner

9.3 Counter-Notification
If you believe your content was removed in error, you may submit a counter-notification to the address above containing the elements required by 17 U.S.C. § 512(g).
9.4 Repeat Infringer Policy
We will terminate, in appropriate circumstances, the accounts of users who are determined to be repeat infringers.
10. Indemnification
You agree to defend, indemnify, and hold harmless Strickland Services Group LLC, its officers, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with (a) your access to or use of the Service; (b) your violation of these Terms; (c) your User Content; or (d) your violation of any third-party right, including any intellectual property, privacy, or publicity right.
11. Limitation of Liability
The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, Strickland Services Group LLC shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service.
Our total aggregate liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed the greater of (a) one hundred U.S. dollars ($100) or (b) the total amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages, so some of the above limitations may not apply to you.
12. Termination
12.1 By You
You may terminate your account at any time by contacting support@frameforged.com. Upon termination, any unused credits are forfeited. Completed orders remain unaffected.
12.2 By Us
We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraud, abused the Service, or if we are required to do so by law. For non-cause termination (e.g., we discontinue the Service), we will refund unused, purchased credits on a pro-rata basis; free promotional credits are not refundable.
12.3 Survival
The following sections survive termination: Section 5 (Intellectual Property), Section 9 (DMCA), Section 10 (Indemnification), Section 11 (Limitation of Liability), Section 13 (Arbitration & Class Action Waiver), and Section 14 (Governing Law).
13. Binding Arbitration & Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.
13.1 Agreement to Arbitrate
You and Strickland Services Group LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, rather than in court. The arbitrator’s decision shall be final and binding.
13.2 Class Action Waiver
You and we agree that each party may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of representative or class proceeding.
13.3 Small Claims Carve-Out
Either party may bring an individual action in small claims court for disputes within the scope of that court’s jurisdiction, in lieu of arbitration.
13.4 30-Day Opt-Out
You may opt out of this arbitration agreement by sending written notice to support@frameforged.com with the subject line “Arbitration Opt-Out” within thirty (30) days of first accepting these Terms. The notice must include your name, email address, and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other part of these Terms.
13.5 Severability
If the class action waiver in Section 13.2 is found to be unenforceable with respect to any claim, then the entirety of this Section 13 (Arbitration) shall be null and void with respect to that claim, and such claim shall be adjudicated in a court of competent jurisdiction under Section 14.
14. Governing Law & Venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. For any dispute not subject to arbitration under Section 13, the parties consent to the exclusive jurisdiction and venue of the state and federal courts located in Leon County, Florida.
15. Changes to Terms
We may update these Terms from time to time. If we make material changes, we will notify registered users by email at least seven (7) days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
16. Miscellaneous
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Strickland Services Group LLC regarding the Service. If any provision is held invalid, the remaining provisions remain in full force. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
